Informative Case

Summary:

A Syrian man called ARDD – Legal Aid to ask for a legal consultation. He informed us that he got married through a customary marriage contract in Syria on May 28, 2012, yet he didn’t register his marriage before the Sharia Court in Syria and he doesn’t have any proof for his marriage. Nevertheless, he registered his marriage under a new date in Jordan in a Sharia Court on November 6, 2013, at a time when his wife was pregnant in her fourth month from their customary marriage. When the wife gave birth to a baby boy, the father tried to issue a birth certificate for him, but the Department of Civil Status refused to issue a birth certificate because the born child was born after only six months of the marriage registration.

 

Given Consultation:

We advised him that he should file a claim before the Sharia Courts to prove his marriage that occurred on May 28, 2012 proving that the child resulted from that marriage, and to cancel the second marriage contract that was issued on November 6, 2013.
